 1. Obtaining Ogrines

1.1 Ogrines are points which allow you to perform certain actions in connection with the online game DOFUS (the "Game"), provided by Ankama Games (the "Company") on the site http://www.dofus.com (the "Site").

1.2 You can acquire Ogrines through one of the payment methods available on the payment website https://secure.dofus.com/en/subscribe. The rates are exclusively given in Euro and include VAT (all taxes included). They do not take the exchange rate and any fees associated with a particular mode of payment into account.

1.3 The Company may amend its tariffs at any time. However, if the payment method is not immediate (e.g., cheque) the applicable rate will be the rate on the day the payment was sent by you, provided the payment is received within 5 business days.

1.4 You acknowledge that any payments you make on the Site for yourself or for a third party are carried out with the permission of the owner of the means of payment in question, otherwise Article 1.6 applies.

1.5 The Company offers various payment methods some of which are operated by third parties not included in this agreement. The Company cannot be held liable in the case of damages on the part of these third parties, particularly in the case referred to in Article 1.7.

1.6 You acknowledge and agree that the Company is not responsible for fraudulent payments made on its Site, regardless of the means of payment.

If you are found to have made a fraudulent payment, that is to say without the consent of the owner of the means of payment, the Company reserves the right to ban your account and take appropriate legal action against you.

Similarly, if you divulge your login information to a third party who proceeds to make a fraudulent payment, the Company may then take the same action against you.

1.7 You are reminded that any person using Audiotel services is deemed to be the holder of the fixed or mobile telephone line subscription (hereinafter the "Subscriber") used to generate AlloPass or have obtained the agreement of the holder.

AlloPass and SMS (Short Message Service) are not provided by the Company, but by a third party.

Premium-rate calls and SMS made by subscribers in obtaining AlloPass are charged by the telephone operator.

The Company cannot be held responsible for any calls made by the Subscriber, nor any bills arising from such communication.

In the case of unauthorized use or theft of a telephone or mobile phone, Subscribers must contact their telephone operator.

Pursuant to several decisions of French courts, you are reminded that "Subscribers are responsible for all use of telephones in their possession."

2. Use

2.1 Ogrines will allow you to:

- Activate services (e.g., change the colour, name and gender of a character, or create more characters on an account)

- Add a subscription to your DOFUS Account (100 Ogrines = 1 day subscription)

2.2 You agree not to resell Ogrines or exchange them in any form whatsoever except by the means provided for by the Company.

2.3 Ogrines have a minimum duration of three (3) months plus one (1) day for every one hundred (100) Ogrines purchased (e.g. 30,000 is equivalent to 300 subscription days; your Ogrines will be valid for 390 days). These durations are not cumulative. Each batch of Ogrines has an independent duration.

2.4 The duration of Ogrines is deemed to begin at the moment of their purchase.

2.5 Prices vary according to the number of Ogrines purchased, the payment method selected and your country of residence (availability of means of payment may vary depending on your country of residence).

2.6 You can check the status of your Ogrines in the Account Management section of the Site.

3. Retraction

3.1 In accordance with Article L121-20-2 of the Consumer Code, you do not have the right of withdrawal provided for in Article L121-20 of the Code for services which are used within seven clear days of purchase.

Thus, the use of Ogrines is deemed to have begun when all or part of the Ogrines purchased are used to activate a service or purchase a subscription.

3.2 Similarly, and pursuant to Article L121-20-2 of the Consumer Code, you do not have the right of withdrawal provided for in Article L121-20 of the Code in respect of services such as Audiotel and Mistercash, the use of which is deemed to have begun within seven clear days of purchase. Services such as Audiotel and Mistercash are instantaneous services which are deemed to be initiated upon purchase.
